Terms of Service

TechMart Technology Services Company Limited (hereinafter referred to as "TechMart", "we" depending on the context) would like to present to our customers ("You", "User", "Customer" or "Subscriber" means individuals or entities that engage with us to use the service) the terms of service agreement. Customer use of TechMart services constitutes acceptance of the explicit terms in this document (Terms of Service) and the specific terms of use for each service.

1. Service Refusal Policy

We have the right to terminate services without refund or refuse future service if the following usage regulations are violated:

  • Using the service to perform acts that violate the laws of the Socialist Republic of Vietnam and international regulations being applied in Vietnam.
  • Using the service to spread content opposing the Socialist Republic of Vietnam, causing religious/political conflicts, pornographic content, or affecting Vietnamese cultural traditions.
  • Using the website to promote online gambling services, betting, or exchange/sale of prohibited products as per regulations.
  • Using server services or server resources to distribute SPAM, advertising mail, BULK, MASS MAIL, or other forms of sending emails from servers with a volume of emails that affects the reputation of IP ranges at TechMart.
  • Distributing and storing malicious code types aimed at attacking other websites, or for the purpose of sabotaging TechMart's system such as Botnet, DDoS, Malware, Virus, Phishing. This includes cases where websites contain malicious code, are infected with malicious code, or are subjected to high-intensity DDoS attacks that seriously affect the system.
  • Using server services to store websites impersonating individuals or organizations causing damage to the honor and reputation of others.
  • Using software that abuses CPU and other server resources such as Coin Mining, website view exchange software similar to Hitleap, etc.
  • Using websites to promote illegal services/products as stipulated in Decree 15/2020/ND-CP.
  • Using the service to store digital content that violates copyright, authorship rights, or content that impersonates other organizations/individuals.

2. Customer Responsibilities

Customers at TechMart always have all the rights and obligations of the service lessee - as stipulated in the Civil Code and Vietnam Commercial Law. To ensure the best interests, customers also need to comply with the following regulations:

  • Customers are responsible for securing their login information to the website system or login information to the control panel for customers at TechMart. Customers have the responsibility to notify us if they detect unauthorized use of passwords.
  • Customers are solely responsible for the content posted on the website and stored on TechMart servers before the law in case of disputes or complaints.
  • Customers are responsible for self-preservation and maintenance of the website and are responsible for any damages resulting from subjective or loose management by the customer.
  • Customers are responsible for self-preservation and maintenance of data, source code on TechMart's storage system. TechMart will not be responsible for data loss incidents due to the customer's loose usage and security capabilities.
  • Customers are responsible for providing accurate information of the person or organization registering for the service, and must ensure that related documents sent to us are accurate such as ID cards, passports, etc. when requested.

3. TechMart's Responsibilities

As a service provider, TechMart has all the rights and obligations of the service provider as stipulated in the Civil Code and Commercial Law. TechMart has the following responsibilities:

  • Provide services with technical specifications as committed on the homepage thuevpsgiare.org.
  • Be responsible for supporting customers throughout the service usage period according to the support policy according to the terms of use of each service.
  • Fully notify customers when there is a service maintenance schedule or changes in the service.
  • Comply with other commitments in this document and related legal documents.

4. Service Suspension

The customer's service will be suspended without prior notice but will receive an email notification of suspension when the service has been suspended in the following cases:

  • Overdue payment of 7 days from the date of service expiration.
  • Service violates the usage policy of the corresponding service.
  • Disputes occur with lawsuits, or is subject to legal inspection.

5. Account Registration

The account on the TECHMART service management system is an account created by the customer during the service registration process. This account will have the function of tracking service term, payment and service renewal, sending support requests and using the specific functions of each service. All new accounts must be registered with valid and verifiable information. Newly registered accounts with incorrect information will be deleted without prior notice. Multiple accounts cannot be registered for one user. You must provide accurate and timely confirmation information to us during your use of service with TECHMART. We may send confirmation of any information changes, and if confirmation cannot be received, we have the right to suspend or terminate your service.

6. Service Cancellation

You must submit a cancellation request from your service management area to cancel the service. You can cancel the service at any time for any reason. All funds in the account will be confiscated at the time of cancellation. You can request us to delete all your personal information at the time of cancellation. All your data on TECHMART's service will be deleted at the same time when the service is cancelled.

7. Billing and Payment Information

Payment Methods
TECHMART supports 3 forms of service payment: Bank transfer and PayPal. Customers have the right to choose the appropriate payment method and the service activation time will also depend on the payment method. For PayPal payment method, our system will automatically activate the service immediately after completing the payment. For bank transfer payment method, the system will automatically activate as soon as TECHMART receives the payment according to the correct syntax.

Prepayment
We need customers to understand that service payments are all prepayments to maintain the service. For service renewals, the system will automatically create an invoice 15 days before the service date to notify customers to pay in advance to avoid the case of service being locked due to late payment.

Automatic Renewal
If customers pay via PayPal, they need to accept that this payment method supports automatic service renewal. If customers cancel the service, they must ensure that they have turned off the Preapprove Payment feature from TECHMART in their PayPal account to avoid self-payment when the cycle arrives even though the invoice has been cancelled. This is a PayPal function beyond TECHMART's control.

Tax
Customers have the obligation to pay taxes for each service. All service prices on the ThueVPSGiaRe.Org homepage do not include VAT.

Late Payment
Customers are responsible for paying to maintain the service on time. The service will be automatically suspended after 7 days of late payment, and data will be completely deleted after 30 days if the service is not renewed.

Payment Refusal
We have the right to refuse payment if non-transparent payment is detected or there are signs of criminal violation.

Refund
We accept refunds when requested within 30 days from the date of service activation. Refund requests must comply with the refund policy and we do not refund 100% for service violations.

8. Support

You need to provide support requests through the ticket system, so we can solve your problem. You can send support issues via email, phone, live chat, support system. In some cases, problem solving may take time so we are sorry we cannot support you faster. Issues are resolved by the assigned team, you do not have the right to request resolution by a specific member, which will delay the resolution of your issues. 9. Complaints

We always try to make the service better. Customers have the right to complain or give feedback about TECHMART's service through the email address [email protected] or the ticket system. Customer complaints will be responded to by us within 48 hours.

10. Limitation of Liability and Disclaimer

In all cases, any TECHMART executive or employee, agents will not be liable for direct or consequential damages. Especially even the loss of customer benefits or data loss due to the customer's subjectivity. Customers also accept that TECHMART has the right to exempt from guaranteeing responsibility for the terms in this document if there is a separate agreement with the customer. Customers are not entitled to exempt from responsibility for the terms stated in this document.

11. Compensation for Damages

In case the customer seriously violates the terms of use leading to losses on TECHMART's infrastructure and personnel, they must fully bear all damage costs. In case TECHMART cannot guarantee the service commitment (SLA), it will compensate through the compensation policy. This balance can only be used by the customer to register for the service or renew, not convertible to cash.

12. Changes to Terms

TECHMART may change the terms of service use, all policies or related legal documents when necessary. Changes will be notified to customers via email when necessary, but customers are responsible for regularly monitoring these documents to ensure they always comply with the terms.
